These Terms and Conditions (“Terms”) govern your use of drinktovi.com and any purchases from Tovi LLC (“Tovi,” “we,” “us,” or “our”). By using the site or placing an order, you agree to these Terms.

1. Who we are

Tovi offers nutritional powder products and related information for adults. The site may include a waitlist, product pages, and checkout when products are available for sale.

2. Eligibility

You must be at least 18 years old (or the age of majority where you live) to use this site or purchase products. By using the site, you represent that you meet this requirement.

3. Waitlist and emails

If you join our email list, you agree we may send you launch and product updates. You can unsubscribe anytime. Joining the waitlist does not reserve inventory or create a purchase obligation unless we clearly offer a paid deposit or preorder and you complete checkout.

4. Products, nutrition information, and no medical advice

  • Product descriptions, nutrition facts, and ingredient lists are for informational purposes.
  • Tovi products are dietary supplements / nutritional foods, not medicines. They are not intended to diagnose, treat, cure, or prevent any disease.
  • Statements on this site have not been evaluated by the Food and Drug Administration (where applicable to supplement claims).
  • Consult a qualified healthcare professional before use if you are pregnant, nursing, have a medical condition, or take medication.
  • Individual results vary. Taste and tolerance preferences differ.

5. Orders, pricing, and payment

When products are available:

  • All prices are in U.S. dollars unless stated otherwise.
  • We may correct pricing or availability errors and cancel orders affected by them.
  • Payment is due at checkout through our payment processors. You represent that you are authorized to use the payment method provided.
  • We reserve the right to refuse or cancel any order (for example, suspected fraud, quantity limits, or product unavailability).

6. Shipping

Shipping methods, timing, and costs will be shown at checkout when products ship. Risk of loss passes to you when we deliver the order to the carrier, unless required otherwise by law. Delays can occur due to carrier or events outside our control.

7. Returns and refunds

Return and refund rules will be posted on the site when products are sold. Until then, contact rydermeehan@gmail.com for any purchase issues. Opened food/supplement products may be non-returnable for safety reasons except where required by law.

8. Acceptable use

You agree not to misuse the site, attempt unauthorized access, scrape the site in an abusive way, interfere with security, or use the site for unlawful purposes.

9. Intellectual property

Site content, branding, logos, and product materials are owned by Tovi or our licensors. You may not copy or use them for commercial purposes without our written permission.

SOME JURISDICTIONS DO NOT ALLOW CERTAIN DISCLAIMERS; IN THOSE CASES, THEY APPLY ONLY TO THE EXTENT ALLOWED.

11. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, TOVI AND ITS OFFICERS, MEMBERS, AND SUPPLIERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR DATA, ARISING FROM YOUR USE OF THE SITE OR PRODUCTS. OUR TOTAL LIABILITY FOR ANY CLAIM RELATED TO THE SITE OR A PURCHASE WILL NOT EXCEED THE AMOUNT YOU PAID TO US FOR THE PRODUCT AT ISSUE IN THE 12 MONTHS BEFORE THE CLAIM (OR $50 IF YOU HAVE NOT PURCHASED).

12. Indemnity

You agree to indemnify and hold Tovi harmless from claims arising out of your misuse of the site, violation of these Terms, or violation of others’ rights, to the extent permitted by law.

13. Governing law

These Terms are governed by the laws of the State of California, without regard to conflict-of-law rules. Courts located in California will have exclusive jurisdiction, except that either party may seek injunctive relief in any court of competent jurisdiction. Consumers may have additional mandatory rights in their home state.

14. Changes

We may update these Terms by posting a new version on the site. Continued use after changes means you accept the updated Terms. If you do not agree, stop using the site.
